Substantive Arguments of Legal Decision:
A Systemic Observation in Times of Biological Risks

This paper aims to achieve a systemic observation on the use of substantial arguments in legal decisions that face the Covid-19 issue as the center of judicial claims. The theoretical basis is supported by Niklas Luhmann's Autopoietic Social Systems Theory, given that the distinction of legal arguments for the operational closure of the legal system becomes essential in the face of new and adverse situations . The work, initially, demonstrates the systemic perspective of legal argumentation, and then, presents an analysis of the use of substantive arguments by the Plenum of the Brasilian Supreme Court in the first year of the Covid-19 pandemic. It is concluded, therefore, that substantive arguments are necessary for systemic learning and coevolution.
