O objetivo deste artigo é enfocar, de forma contrastada, as perspectivas de
Bronislaw Malinowski e de Alfred R. Radcliffe-Brown, entendidas como distintas concepções
paradigmáticas da antropologia jurídica. Para tanto, inicialmente, são indicadas
as características fundamentais atribuídas por John L. Comaroff e Simon Roberts
ao que designam de “paradigma processual” e de “paradigma normativo” da antropologia
jurídica. Feito isso, é realizado um conciso exame do pensamento de Bronislaw
Malinowski para, a partir dele, ilustrar o “paradigma processual”. Em seguida, é enfocado
o pensamento de Alfred R. Radcliffe-Brown como expressão do “paradigma
normativo”. Por fim, à guisa de conclusão, é apresentada uma breve síntese da temática
analisada.
