O gambling act 2005 e a regulação dos jogos de azar no Reino Unido

No Reino Unido, os jogos de azar são considerados como uma forma legítima de lazer sobre a qual o Estado não deve intervir de forma paternalista e excessivamente restritiva. Em vez disso, deve promover o desenvolvimento orgânico e competitivo do mercado, mas sem olvidar os cuidados necessários a prevenção e mitigação dos males inerentes à atividade e a garantia de melhores condições e produtos aos consumidores. Para isso, o Reino Unido aplica um dinâmico sistema de regulação que estabelece objetivos, meios e limites para exploração comercial dos jogos de azar. Este artigo busca apresentar e analisar esse sistema de regulação, pontuando suas principais suas principais características e efeitos, através de uma investigação jurídico-dogmática do Gambling Act de 2005. Norma que estabelece a política estatal de regulação essencialmente econômica dos jogos de azar, e que condensa as principais normas relativas à prática, exploração e controle dessa atividade no Reino Unido.
