The gambling act 2005 and the regulation of gambling in the United Kingdom

Abstract

In the United Kingdom, gambling is considered a legitimate form of leisure in which the state should not intervene in a paternalistic and excessively restrictive way. Instead, it should promote the organic and competitive development of the market, but without forgetting the necessary precautions to prevent and mitigate the problems inherent in the activity and to guarantee better conditions and products for consumers. To this end, the United Kingdom applies a dynamic system of regulation that establishes objectives, means, and limits for the commercial exploitation of gambling. This article aims to present and analyse this regulatory system, highlighting its main characteristics and effects, through a legal-dogmatic investigation of the Gambling Act of 2005. An act that establishes the state's policy of essentially economic regulation of gambling, and which condenses the main rules relating to the practice, exploitation, and control of this activity in the United Kingdom.
