A sociedade do risco e o direito penal simbólico

A existência, a legitimidade e a possibilidade da supressão do Direito Penal vem sido debatida pelos seus especialistas desde o início da sua crise. A crise moral social o expande e o transforma no Direito Penal do inimigo. O Direito Penal do inimigo e a sociedade do risco lhe causam consequências agravadas pela imprensa; dentre elas o simbolismo do Direito Penal.
O objetivo deste artigo é desvendar o Direito Penal simbólico através da análise da evolução do Direito Penal, da origem da sociedade do risco e das suas conseqüências e da origem do Direito Penal simbólico, das suas conseqüências e das suas soluções alternativas possíveis através da metodologia da pesquisa histórica e da metodologia da pesquisa teórica. Analisando a evolução do Direito Penal, compreendendo a sociedade do risco e solucionando o Direito Penal simbólico, é possível agir na esperança do Direito Penal mais humanitário.
