Abstract

In the context of economic globalization and rapid technological advancements, Regulatory Law plays a crucial role, managing the tension between promoting free enterprise and protecting public interest. Regulatory agencies, positioned at the intersection between government, market, and society, are pivotal in ensuring efficient public services and preserving fair competition, supported by the principle of their internal autonomy. This autonomy, essential for independent decisions aligned with social welfare, is examined through the lens of ADI 1949/RS, a case that highlights the influence of the Supreme Federal Court in defining the limits of this independence. This article investigates the impact of this autonomy on Brazilian regulatory agencies and its role in strengthening economic regulation, promoting a debate that transcends national borders and contributes to the academic dialogue on the future of Regulatory Law.
