This article aims to map how contemporary jurisprudence deals with the challenges related to the indeterminacy of legal interpretation and the consequent control of judicial power. On the one hand, it is observed how contemporary interpretativism resumes the jusnaturalist matrix of legal thought, which observes law as an exercise of practical reason and as the embodiment of a moral order that is not arbitrary, but based on a certain hierarchy and unity of value. On the other hand, the specificity of the positivist project of observing the law as an authority decision can be noted: born out of a historical movement of positivization of natural rights by the liberal revolutions, which leads to formalist views of interpretation, positivism opposes formalism and supports the construction of analytical theories and of realist theories. At the crossroads between these two matrices of Western legal thought, we observe the contemporary emergence of a renewed and selective legal formalism.
