THE CONSTITUTIONAL THEORY OF REHABILITATION AND FUNDAMENTAL RIGHTS
AMBIGUITIES AND WEAKNESSES OF THE PARADIGM
Keywords:
rehabilitation; fundamental rights; prisonAbstract
This article critically examines the transformation of constitutional discourse on imprisonment in the Italian context, focusing on the role played by the Constitutional Court and the European Court of Human Rights in redefining the limits of punitive power. It argues that the rehabilitative paradigm, while historically contributing to the humanization of punishment and to limiting the prison’s administrative discretion, remains marked by a structural ambivalence. It operates both as a guarantee-oriented language for containing punitive excess and as a device of differentiation, control, and selection among prisoners. This ambiguity emerges especially in the discretionary nature of treatment programs and in the fact that access to prison benefits often depends on unevenly distributed social and economic resources. The article therefore suggests that the protection of detained persons should be grounded more firmly in fundamental rights than in the rehabilitative paradigm alone.
