THE MADINA CASE AND THE PROTECTION OF THE BEST INTERESTS OF THE REFUGEE CHILDREN AT THE EUROPEAN BORDERS: A REAL PRIORITY?

This article examines the systemic violations of refugee children’s rights at the European borders, using the tragic case of Madina Hussiny, a six-year-old Afghan girl, as a central narrative. It highlights the failure of border policies and asylum procedures in prioritizing the best interests of the child, despite international legal frameworks such as the UN Convention on the Rights of the Child and UNHCR Guidelines. The study also explores the criminalization of solidarity, barriers to legal protection, and the inadequate response of national and European institutions. The article calls for a rights-based and child-focused reform of refugee reception policies in the European Union.
