O CASO MADINA E A PROTEÇÃO DO SUPERIOR INTERESSE DAS CRIANÇAS REFUGIADAS NAS FRONTEIRAS EUROPEIAS: UMA PRIORIDADE REAL?

Resumo

Este artigo examina as violações sistêmicas dos direitos de crianças refugiadas nas fronteiras europeias, utilizando o caso trágico de Madina Hussiny, uma menina afegã de seis anos, como narrativa central. Destaca-se a falha das políticas de fronteira e dos procedimentos de asilo em priorizar o melhor interesse da criança, apesar dos marcos jurídicos internacionais, como a Convenção das Nações Unidas sobre os Direitos da Criança e as Diretrizes do ACNUR. O estudo também explora a criminalização da solidariedade, as barreiras à proteção jurídica e a resposta inadequada das instituições nacionais e europeias. O artigo defende uma reforma das políticas de acolhimento de refugiados na União Europeia baseada em direitos e centrada na criança.

Asja Korbar, University Psychiatric Hospital Vrapče

Is an experienced project manager with a professional history in education and human rights in Europe. She holds an MA in Philosophy and Hungarian studies from the Faculty of Humanities and Social Sciences (University of Zagreb). She is a co-founder of the international organization dealing with the rights of refugees ‘Are You Syrious?’, ex-coordinator of the Romani Early Years Network Croatia (REYN) dealing with the rights of Roma children, and a co-author of research reports on minority education in Vukovar, Croatia. She is alumni of the International Institute for Genocide and Human Rights Studies – Zoryan Institute and University of Toronto (2014). Head of Project Coordination and Community Engagement.
