URBAN ENERGY LAW:
MUNICIPAL SUSTAINABILITY AMID ELECTRICAL FEDERALIZATION AND URBAN ORDER
Keywords:
Energy equity; distribution concessions; registry interoperability; operational open data; saidi/saifi indicators.Abstract
The article presents Urban Energy Law as a key to recompose, at the municipal scale, the interface between electrical networks and land-use planning without breaking sectoral federalization. It pursues four articulated objectives: to explain the doctrinal construct and its limits; to identify typical territorial frictions (connections in risk areas, occupation and clearance of utility poles, retrofit of the building stock, public lighting); to design legal operational coordination routines anchored in verifiable metrics by neighborhood; and to propose a contractual roadmap for the new cycle of distribution utilities. The methodology combines legal-dogmatic analysis and comparative documentary review (Laws No. 9,074/1995 and No. 9,427/1996; the City Statute; Laws No. 12,608/2012 and No. 13,465/2017; ANEEL Normative Resolution No.1,000/2021; MCOM/MME Ordinance No. 10,563/2023 –PNCP; Decree No. 12,068/2024, art. 16), a literature review on urban-energy transitions, and external comparison with Uruguay (Law No. 18,308/2008). It includes two synthetic case studies of public-private partnerships for lighting in Guarapuava and Belo Horizonte, as well as a proposal framework with clauses sensitive to the municipality, standards for the physical integration of the network, and operational data disclosure. The results organize four coordination axes — addressing/risk, regularization/projects, buildings/ connection, data/oversight — and indicate territorial indicators such as DEC/FEC (equivalent to SAIDI/SAIFI), compliance of pole occupation, and cleanup times. It concludes that the urbanistic integration of energy improves decision-making, reduces illegal connections and risk, and aligns service performance with local sustainability goals.
